Work on public holidays

Holidays are loved by everyone except those who are forced to work these days. And how is the work paid for when entering it on weekends and holidays and in general does the employer have the right to be required to work at this time?

Work on weekends and holidays

There are categories of citizens who, under no circumstances (even with their consent) can not be called to work during holidays and weekends. These are pregnant women and employees under 18, except for people of creative professions. In other cases, the law does not prohibit setting a schedule for work on holidays, but there are restrictions.

  1. The employer is obliged to warn about the need to work on employee's holidays. The consent of the employee in writing is necessary. The employer's decision to establish a special schedule for work on holidays is issued by order.
  2. If you want to do weekends or holidays for employees, the employer must take into account the opinion of the elected trade union body of the company.
  3. For work on a day off and on a public holiday, people with disabilities and women with young children (up to 3 years old) can be attracted only in view of their state of health, and with a warning that they have the right to refuse work on such days.
  4. The law stipulates special cases when the employer has the right to attract employees to work on holidays. For example, if there is a need to perform unforeseen work, on which the future successful operation of the enterprise depends. In this case, the consent of the employee is mandatory.
  5. The consent of the employee to work on public holidays is not required if it is replaceable. Because in this case the employee has already given his consent at employment and signing of the labor contract.
  6. Some religious holidays are non-working, because they are included in the number of state or are determined at the regional level. Work in other church holidays is conducted in the usual way. In Ukraine, if an employee professes not Orthodoxy, he can take a day off for the holiday (no more than 3 per year) with subsequent work-off.

Payment for work on public holidays

Naturally, we are most interested in the issue of paying for work on holidays, are there any extra charges? Still as it is put, after all we spend time for work, depriving ourselves of the lawful and necessary rest. In how to pay for work on weekends and holidays, the laws of Russia and Ukraine express complete agreement.

  1. Employees who receive wages for the number of products produced (piecework system of payment) when entering work on weekends or holidays, the employer must pay it no less than double the rates.
  2. Employees who receive wages on the basis of worked days and hours, work at a weekend or holidays should be paid at a rate not less than a double daily or hourly rate.
  3. Employees who receive salary for entering work on weekends or holidays should receive an additional payment not less than a single hourly or daily rate if the work was within the norm of working time per month. If this rate is exceeded, the employer is obliged to make an additional payment of not less than a double daily or hourly rate.
  4. At the request of an employee who went to work on a public holiday or a legal day off, other days for rest may be provided to him. At the same time work on holidays (days off) should be paid in a single amount, and days of rest are not paid.

The exact amount of payment for days (hours) of work on holidays is established by the employer and is reflected in the employment contract, the collective agreement of the organization and other regulatory acts of the company.
