When the child falls ill, his parents, as well as grandmothers and other relatives begin to decide who will be with him at home. Most often this decision is made taking into account who is better protected financially, that is, who at work has the best conditions for paying a sick-list. In this article, we will tell you about how the sick child is paid for child care, including the disabled, in Ukraine and Russia, and in which situation the employer has the right to ignore your demands for payment of cash.
Payment of sick leave for child care
Often, it is important for parents to know whether the sick leave caregiver is paid to his relatives who are not close family members. According to the current legislation of Russia and Ukraine, if the child is sick, any disabled member of his family can receive the list of disability for the period of his illness, and the adopter or guardian in foster families. At the same time, according to the law to confirm the fact that a caring adult with a child are blood relatives, it is absolutely not necessary.
For parents with many children for the period of the disease of two or more children, several sheets of disability, for each child, or for one child at all, can be issued at once. This is decided by mom and dad, taking into account who exactly misses the work while the kids are sick. If the mother sits with all the children, she is given one hospital, which shows the data of all her sick children. If, for example, one child is in a medical institution with his mother and the other is treated at home, and the father looks after him, each parent is given out his sick-list with the name of one of the babies.
In certain cases, the employer has the right to reject your claims for sick pay, such as:
- for the period of treatment of your son or daughter who are already 15 years old, in a hospital or in a hospital of any medical institution;
- in the period of leave, and not necessarily paid.
In all other situations, the list of incapacity for work should be paid to the mother of the baby or to any other relative who was obliged to miss work during the period of the disease. Meanwhile, under the laws of Russia and Ukraine, there are some restrictions.
Thus, in Ukraine, a sheet of incapacity for work for a person caring for a minor child is paid only up to 14 years and only for 14 days of the baby's stay in the period of illness. If your child is in hospital during illness, all this period is payable.
In Russia, you can "sit" in a hospital for the care of your daughter, son or other minor relative until you are 18 years old. At the same time, sometimes it is paid only partially, according to the rules:
- when caring for crumbs up to 7 years - for the whole period, but not more than 60 days per year;
- from 7 to 15 years - for 15 days in the period of one episode of the disease and not more than one and a half months per year;
- the list of incapacity for the care of a disabled child under 15 years old must be paid in full. At the same time, the total duration of paid days for the illness of a toddler can not exceed 120 per year;
- at home treatment of a girl or boy over the age of 15 under the supervision of a doctor, the disability sheet is paid only for the first three days.
How is the hospital child care calculated?
In both countries, the amount of the sickness benefit directly depends on the duration of the employee's total insurance experience. In the case when it exceeds 8 years, the allowance for the period of the sick-list must be equal to 100% of the average salary. Accordingly, for individuals with an insurance record of 5 to 8 years, this figure is 80%, and for those who have not worked and 5 years, 60%.
In any case, such a calculation scheme is only used to calculate the allowance for 10 days of the disability sheet. All subsequent days are paid based on 50% of average earnings.
