Shortened working day for pregnant women

Everyone knows that discrimination against women in the workplace is quite common. Some employers even before taking a woman to work, make her take a pregnancy test. Such actions are illegal, and are prosecuted by law. The main thing is to know this, and understand that the owner does not have to refuse to hire a pregnant woman at any time.

Different ways the pregnant woman tries to be oppressed at work not only by the authorities, but also by co-workers, on whom part of the duties are transferred. If the employees need to negotiate amicably, then the knowledge of labor law only acts with the authorities .

Any pregnant woman, regardless of whether she feels well or not, should be transferred to easy work, but with the written consent of both parties. In this case, the salary remains the same. Even if the company does not have such a post, to which a woman can be transferred, an excessive burden is removed from it. But do they reduce the working day to pregnant women?

Not everyone knows that a shorter (shorter) working day for pregnant women is provided for by law. This issue is regulated by the Labor Code of the Russian Federation, Article No. 93. This normative document states that at the request of the woman herself, the owner (director, manager, etc.) is obliged to transfer a woman for part-time work or a week, regardless of the form of ownership of the enterprise.

The Ukrainian women are protected in the same way, after all, according to the Labor Code, Article 56 they have the right to reduce both the working day and the week. In addition, according to clause 9, article 179, a woman who is on a decree has the right to take work at home, if possible, and simultaneously receive child benefits and wages.

If the employer refuses this, the woman can apply with a relevant application to the court and win it, after which she will be reinstated, and the owner will be fined. Many do not lead the case to litigation and eventually agree to reduce the working day to pregnant women.

What should be a working day for pregnant women?

There are three types of work time reduction:

  1. Part-time work for pregnant women. This means that for a day a woman will work for several hours less (there is no clear figure, it all depends on the agreement between the parties)
  2. Part-time work week. The working day remains the same in duration, but instead of five days, the woman will work three.
  3. Mixed type of reduction of working time (day, week) to pregnant women. The days are shortened (three instead of five), and the hours (five, not eight). In order to switch to reduced working hours, it is necessary to write an application, sign a bilateral agreement and attach a certificate from the doctor about the presence of pregnancy. Unfortunately, as the time decreases, the salary becomes less (proportionally), which is stipulated by law. But light labor is paid in the same amount.
